Prospective Marriage Visa (subclass 300) are intended for individuals who wish to visit to Australia and get married with an Australian citizen, PR, or a New Zealand citizen. Once the visa is approved, the couple has nine months to get married and apply for Partner visa.
One of the tough aspects of Australia’s Covid travel limitations has been the ban of subclass 300 visa holders from arriving Australia.
Even Though there is no sign of the travel restrictions reducing at this stage, the Department of Home Affairs is holding measures to support Prospective Marriage visa holders. In a judicial change dated 10 December 2020, the Department has extended the subclass 300 visa time for some visa holders.
The Regulations expand the duration of Subclass 300 visas to 31 March 2022, if the visa holder or ex- holder was outside Australia on 10th Dec 2020, and the visa was in effect at any time through the period from 6th Oct to 10th Dec 2020.
This is a major extension of visas that else expire 9 months after the date of grant. It also includes individuals whose visa has already ended if it was in effect from 6th Oct 2020 to 10 December 2020.
According to Department of Home Affair’s, individual visa holders will be immediately notified by the Department. Holders who obtain an extension to their visa validity, but do not tour to Australia as holders of a Prospective Marriage visa, may come to be eligible a refund of the Visa Application Charge (VAC).
The Department is presently working to conclude arrangements around how VAC refunds will be operated, with refunds expected to be offered by late February 2021.
