On 18th April 2017, Temporary skilled Visa – 457 Visa was abolished and got replaced with the new visa subclass 482 Temporary Skill Shortage (TSS) visa that supports businesses in Australia who can’t find a skilled worker with the required skills.
What Options available for TSS (482 visa) and how it replaces 457 visa Subclass?
The new 482 visa available in different streams permits visa holder to live in Australia while working full time for sponsor employer.
Short term Stream
✅ Short term visa you can stay up to 2 years or 4 years if ITO applies.
✅ The nominated occupation must be on short term skilled occupation lists. STSOL occupations are eligible for this stream. Link to Skilled occupation
✅ 2 years of work experience in the related nominated occupation.

✅ Minimum English standard proficiency unless exempt.
Medium term Stream
✅ Medium term visa you can stay up to 4 years. Both Short term and a medium applicant can visit multiples times
from to and fro to Australia.

✅ 2 years of work experience in the related nominated occupation.

✅ Higher English level required than Short term Visa and Minimum English standard proficiency criteria can be check here unless exempt.

If applicants from UK, USA, Canada, NZ or Ireland, they will be exempt from English proficiency.
What is the eligibility criteria for 482 Visa Subclass?
To be eligible for this visa, you must:
- Have an eligible occupation on the relevant Department of Home Affairs’ Skilled Occupation List;
- You must Have a job offer;
- Must Have at least 2 years’ of working experience in the nominated occupation;
- Have a genuine intention to work in the nominated position;
- Meet the skill level for your nominated occupation;
- Must Have adequate arrangements for health insurance; and
- Meet health, character, and English requirements.
How long can I stay in Australia with 482 visa?
The allowed duration of your stay will depend on what stream you apply to, having met the relevant criteria.
- Short-term stream: Up to 2 years or up to 4 years if an International Trade Obligation (ITO) applies. Hong Kong passport holders may stay up to 5 years.
- Medium-term stream: Up to 4 years. Hong Kong passport holders may stay up to 5 years.
- Labour Agreement stream: Up to a maximum of 4 years, depending on the terms in the labour agreement. Hong Kong passport holders may stay up to 5 years.
What is Application Process?
First, see if the Consolidated Skilled Occupation List includes your line of work.
Second, confirm that you satisfy the qualifying conditions listed below, including:
- You fulfil the health and character criteria necessary for all Australian visa applicants.
- You have enough English language proficiency.
- Make effective arrangements for health insurance (Condition 8501, Condition 8601) when visiting Australia.
Third, confirm that your business is prepared to sponsor your employment in Australia. The sponsoring business can finish the procedure by submitting the DHA’s online sponsorship request (Department of Home Affairs).
A nomination from your workplace is then required. Make sure your employer nominates you for the visa for temporary skill shortage once you locate the employment (subclass 482). The main DHA website is where the sponsorship application may be submitted
Register for your visa for temporary skill shortages at the end (subclass 482). When your company submits the application to sponsor and nominate you, you can submit an application for your TSS visa at the same time. And then wait for a response. DHA often takes two to three weeks to decide on something.

TSS 482 visa involves a three-step process:
1.) Business sponsorship: A sponsorship application by the employer of Australia lawfully run a business under ABN; have register business name, BAS statement, and financial records.
2.) Nomination: This is submitted by the employer a nomination application for a skilled position which includes the details on the position, case study how position becomes vacant and why. An employer must nominate a position and justify why this needs to be filled in by overseas citizen and as part of it need to met some requirements like

3.) Visa application: Application needs to be submitted by the nominated employee.

What is Condition 8607 and How Does it Relate to TSS Visas?
A worker must start working within 90 days after arriving in Australia after receiving a visa, according to Condition 8607. The employee must work for the authorised employee for at least 60 days in a row; the time period begins for onshore applicants on the day the visa request is accepted; and ensure you get any necessary licences, registrations, or memberships.
The new employer would also need to submit a fresh application for nomination and sponsorship.
